Terms & Conditions

Booking Conditions

Please read the following terms and conditions (the ‘Terms’) carefully before you book. They set out the terms on which you and the other people on your booking form ('you') enter into a contract with Tenuta Montefino. The Terms set out Tenuta Montefino's obligations to you and your commitments to Tenuta Montefino when you make a booking.

1.CHANGES TO YOUR BOOKING REQUESTED BY YOU

It is extremely unlikely that Tenuta Montefino will be able to make changes to your booking once a confirmation invoice has been issued. However, if, after Tenuta Montefino has issued the confirmation invoice, you wish to change the dates you have booked, or to alter your booking in any way, Tenuta Montefino will do all it reasonably can to meet your wishes, provided that Tenuta Montefino receives confirmation of the requested change from the person who has signed the booking form in writing. Any additional expenses incurred by Tenuta Montefino as a result of making changes to your booking at your request will be agreed with you in advance and added to the cost of your booking. Tenuta Montefino cannot, however, guarantee that it will be able to make any changes at all, and it may therefore have to treat your request as a cancellation and new booking and levy the cancellation charges set out at paragraph 4 below. If such cancellation charges do become payable as a result of a change requested by you, Tenuta Montefino will tell you about them before issuing a new confirmation invoice.

2. CANCELLATION OF YOUR BOOKING BY YOU

If you want to cancel your booking, the person who signed your booking form must send a signed instruction to Tenuta Montefino, requesting a cancellation. Also, a copy of the signed instruction must be sent by email. A cancellation will not be effective until it is received in writing by Tenuta Montefino’s owner. You will then be liable to pay the cancellation charges on the scale shown below. Once a confirmation invoice has been issued, it is very unlikely that Tenuta Montefino will be able to re-let the property should you wish to change or cancel your booking due to the exclusive nature of the property and its high rental value. The cancellation charges therefore reflect the owner's estimated loss as a result of dealing with your booking to the point of change or cancellation and any other losses Tenuta Montefino and the owner may have incurred.

The cancellation by the client, for any reason, implies the payment by the client of the following amounts:

  • If the cancellation takes place more than 30 days prior arrival: 30% of the total amount
  • If the cancellation takes place 30 days or less prior arrival: 100% of the total amount
  • If a cancellation is received 30 days or less from the Arrival Date: 100% of the full property rental price is due irrespective of whether this amount has been received by Tenuta Montefino.

Any amount which you have already paid will be taken by Tenuta Montefino to contribute to the above cancellation charges. You may be able to make a claim under your travel insurance policy if your cancellation falls within its terms and conditions.

3. CHANGES TO YOUR BOOKING BY TENUTA MONTEFINO

Whilst Tenuta Montefino seeks to avoid making changes to confirmed bookings this may sometimes be unavoidable.

There may be some minor changes made before your Arrival Date, and, if so, Tenuta Montefino will try to tell you about them in advance. Exceptionally Tenuta Montefino may have to make a major change to your booking. Major changes are when the property you have booked becomes unavailable or Tenuta Montefino has to change the dates of your booking.

All other changes are classed as minor. In the event of a major change, Tenuta Montefino will tell you as soon as possible before the start of the rental period. You may then (a) Accept the alternative arrangements, or (b) cancel your booking and obtain a full refund of all payments made by you.

The full refund would be returned within 15 working days of receiving written notice of your

cancellation. If you choose to rent the property at a period where a higher rental price applies, you

must pay the difference if it is more expensive. Where it is cheaper Tenuta Montefino will of course refund the difference. On very rare occasions, it may be necessary to make a major change to your booking after it has commenced. Major changes are due to events such as, but not limited to, an exceptional power failure, damage by earthquake, flooding, burst pipe or any event that would preclude the use of the property. Where Tenuta Montefino has to make a major change after your booking has commenced, Tenuta Montefino will reimburse the unused part of your stay on a pro-rata basis.

4. CANCELLATION OF YOUR BOOKING BY TENUTA MONTEFINO

Tenuta Montefino may have to cancel your booking in exceptional circumstances (exceptional circumstances do not mean the owners keeping the property for themselves or other guests), in which case you will be offered a full refund of all monies paid. Please note that the above sets out the extent of Tenuta Montefino's liability to you in the event of cancellation by Tenuta Montefino. In no circumstances whatsoever can Tenuta Montefino be liable to any compensation over and above the full reimbursement.

5. TENUTA MONTEFINO'S RESPONSIBILITIES

Tenuta Montefino takes all reasonable steps to ensure that proper arrangements are made for all its bookings.

However, any compensation that Tenuta Montefino may pay for claims against it under this paragraph 5, will not be for more than the price paid to Tenuta Montefino by those affected.

Tenuta Montefino will not be responsible to you for any damage caused as a result of any failure to perform, or improper performance of, its obligations under the Contract where such failure or improper performance is not Tenuta Montefino's fault because:

• such failure or improper performance is due to unusual and unforeseeable circumstances beyond Tenuta Montefino's control, the consequences of which could not have been avoided even if all due care had been exercised, or to an event which Tenuta Montefino, even with all due care, could not foresee or forestall. Such circumstances or events include (without limitation) war or threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disasters, fire or adverse weather conditions;

• such failure or improper performance is attributed to a third party; or

• such failure or improper performance is attributable to you or to any member of your party.

Furthermore, Tenuta Montefino does not accept liability for loss of or damage to personal property. You may be able to make a claim under your travel insurance policy for such loss or damage. Particularly, it is your responsibility to ensure that all your valuables and documents are kept safe at all times.

6. INFORMATION REGARDING THE PROPERTY

All information regarding the property and any other material showed to you by Tenuta Montefino is based on the information available at the time. However, Tenuta Montefino reserves the right to change any information before your booking, including the price, and such amended information will then form part of the Rental Agreement. If there are any major changes, Tenuta Montefino will tell you about them before you enter into the Rental Agreement. However, if Tenuta Montefino is forced to withdraw or limit any facilities or services referred to in any material showed, such as the supply of water, electricity, communications, fuel or gas, Tenuta Montefino will try to tell you beforehand and where appropriate and will pay you compensation. However, Tenuta Montefino cannot pay compensation for events which are outside its control, nor for minor changes which will not affect the enjoyment of your stay, such as alterations to furnishings or interior design.

7. HOUSEHOLD STAFF

Tenuta Montefino does all it can to ensure that the property has high standards of comfort and service.

However, it is important for you and your party to appreciate that the property is a unique, privately-owned and privately-staffed home with its own character and qualities. The property is not a commercially-run, 5-star establishment, and you should not expect the same level of

service that you would find in a luxury hotel. It is hoped that you will appreciate and respect the

charm of being personally served by staff some of which have lived with the family for many

years. It is your responsibility to check whether the staffing arrangements and facilities meet

your party's needs. You must notify Tenuta Montefino at least 8 weeks in advance if you require extra staff or resources to be hired on your behalf at any time during your stay. The costs of such staff or resources will then form part of the rental price of your property and will be charged accordingly.

8. SERVICES AND FACILITIES

INCLUDED WITH THE RATE:

  • Electricity, water and final cleaning
  • Morning daily housekeeping service for 4 hours – Sundays 2 hrs
  • Laundry (washer and dryer) & ironing facilities on the premises at guest’s disposal
  • Gardener and pool maintenance service

NOT INCLUDED/EXTRA, ON REQUEST, TO BE PAID LOCALLY, IN CASH

Please advise your client that the following services and respective rates are estimated and are

subject to change without prior notice:

  • Heating charged depending on usage, approx. € 200 per day
  • A/C portable units: approx.. € 500 per week (6 units)
  • Cook service: € 30 for hour, plus cost of ingredients
  • Extra cleaning and service € 15 for hour
  • Personal laundry and ironing service: € 15 for hour
  • Babysitting service (subject to availability): € 15 for hour
  • Telephone charges extra
  • Tourism tax

Smoking: smoking inside Tenuta Montefino is strictly forbidden. Guests are only allowed to smoke in the outdoor areas of the property. The penalty amount in case of a breach of Tenuta Montefino’s smoking policy is set at EUR 1’000, to be paid before your Departure Date.

9. YOUR INSURANCE

As a condition of booking, we recommend you to take appropriate insurance.

Medical treatment overseas and the cost of repatriation in the event of emergency can be very

expensive, and it is therefore vital that you and your party are adequately insured. Tenuta Montefino is unable to accept responsibility for any costs that you or anyone in your party may incur as a result of failing to take out appropriate insurance cover.

It is your responsibility to familiarize yourself with the grounds and if necessary, restrict access to certain areas especially to children. If unsure about the safety of any device, socket, or any part of the house, please make the staff and Tenuta Montefino aware of it immediately.

10. SPECIAL REQUESTS

Tenuta Montefino will try to meet any special requests as long as they are requested well in advance of your Arrival Date. This is particularly important for the peak season.

However, Tenuta Montefino cannot promise that such requests will be complied with and will not pay compensation if it is unable to meet them.

11. YOUR PARTY

You may change the details of those in your party after your booking has been made by sending a request in writing by the person who has signed the booking form to Tenuta Montefino. It is important that you do this as only those people detailed on the booking form may use the property.

If it comes to the attention of Tenuta Montefino or staff that the number of people staying exceeds the number on the booking form, we may at our discretion ask those people who are not detailed on the confirmation invoice to leave immediately. Should this happen, Tenuta Montefino will not be liable to pay you any compensation nor to refund any monies paid.

Given the delicate nature of the contents and structures of the house the number of people in the property is restricted to 10 people. For drinks parties the number of guests is restricted so that no more than 10 people are present at any time at the house. No food is allowed in the bedrooms/sitting rooms. Dinners or lunches must be taken in the dining room/terrace and the total number of people at the table must not be more than 10. These numbers are absolute and are inclusive of the guests staying at the property. No stand-up dinners are allowed without written permission from the owner.

12. DEPOSIT AND DAMAGES

As per the Rental Agreement, Tenuta Montefino will require a security deposit from you to cover the costs of any damages or breakages during your stay, plus any small costs you may incur such as telephone charges that can only be known later.

The security deposit shall be released 15 days after the departure if any damages or extra costs will not be found. Any damages must be reported to Tenuta Montefino’s owner (having informed the staff is not sufficient) immediately. If you or any member of your party cause any damage to any property or person, you agree to indemnify Tenuta Montefino for any loss the owner may suffer as a result of such damage, including legal costs.

The house is furnished with valuable antiques many of which are fragile. By signing this document you acknowledge that you know how to use and live with antiques. The deposit is only a security and does not represent in any way a limit to your liability. As the property is furnished with many antiques whose value greatly exceeds the security deposit, it is your responsibility that they are not damaged in any way as the costs associated with repairs or replacement will be perused by the owner. In no case can the security deposit be used to pay for your expenditure such as food costs, taxis, etc. The full amount of the security deposit must be in place during the entire stay.

13. OUTSIDE SUPPLIERS

Outside suppliers, such as outside caterers and party organizers, are not allowed without written

permission from the owner.

14. YOUR BEHAVIOUR

If your behavior or that of any member of your party is likely, in the opinion of the owner and the staff, to cause distress, damage, danger or to annoy others, the house manager may ask you and your party to vacate the property immediately. This will be treated as a cancellation by you and you will have to pay the cancellation charges set out at paragraph 2 above. Tenuta Montefino will not be liable for any further costs you may have to pay as result of early termination of your stay in such circumstances. For security reasons we ask that no photographs are to be placed on the Internet or introduced in the public domain in any way and on any medium. Photographs at the property may not be used or sold for profit without the approval of the owner and Tenuta Montefino.

15. IF YOU HAVE A COMPLAINT

The owner and Tenuta Montefino will do their best to ensure the enjoyment and comfort of your stay but occasionally things can go wrong. If you have a problem or complaint during your stay, you must inform the staff as soon as possible. If your complaint cannot be resolved there and then, you should notify Tenuta Montefino by telephone or email immediately and we will do our best to assist. If any complaint has not been satisfactorily resolved upon your return, you should write to Tenuta Montefino within 14 days of the end of your stay. As it is difficult to investigate a complaint a long time after the event, Tenuta Montefino does not have to deal with complaints received after the 14-day period or

which you did not report to Tenuta Montefino at the time. If you leave the property before the end of the rental period, Tenuta Montefino will not be liable to pay you any compensation nor to refund any monies paid.

16. THE CONTRACT

If any part of the Contract is found to be unfair or unreasonable, the remaining terms will still be valid.

Neither you nor Tenuta Montefino may transfer any rights arising under it without the other's prior written consent.

No waiver of any term or condition of the Contract will be effective unless made in writing.

17. LAW AND JURISDICTION

The Contract and any matters arising from it shall be governed and construed in accordance with

Italian law and is subject to the jurisdiction of the courts of Italy.
